Terms of Service

Welcome to NYC Guardians (“NYC Guardians,” “we,” “us,” “our”). By purchasing from or using our website at nycguardians.com (the “Site”), you agree to these Terms of Service (the “Terms”). If you do not agree, please do not use the Site.

1) Who may use the Site

You must be at least 18 years old and able to form a binding contract to purchase from us. You agree to provide accurate information and to comply with all applicable laws.

2) Products & suitability

We sell pet-waste bags and related accessories. Some products are labeled “compostable.” Compostable claims apply only as marked and are generally intended for industrial composting facilities; such facilities may not be available in your area. Not suitable for home composting in the U.S. You are responsible for checking local rules and proper disposal.

3) Orders, pricing & payment

All orders are subject to acceptance and availability. Prices are shown in U.S. dollars and may change without notice. We may cancel or limit quantities at our discretion (e.g., suspected fraud). We collect applicable sales tax based on your shipping address.

4) Subscriptions (Auto-Renew)

If you purchase a subscription (e.g., monthly, every 2 months, or every 3 months):

Your subscription auto-renews until canceled.
The charge each cycle includes the product price minus any subscription discount and shipping is charged on every delivery.
You can pause or cancel before the next renewal from your account or by emailing us.
If payment fails, we may suspend or cancel shipments.

5) Shipping, local delivery & pickup

U.S. Shipping: Estimated 2–5 business days. Flat rate $5.99; free shipping on orders $35+.
Local Delivery – Manhattan: Estimated 2–5 business days. Flat rate $3.99; free at $35+.
Local Pickup (NYC): 1634 Lexington Ave, New York, NY 10029. Bring your order confirmation.
Risk of loss passes to you upon our delivery to the carrier or upon pickup/delivery completion. Delivery times are estimates only.

6) Returns & refunds

Please see our Refund & Returns Policy, which is incorporated into these Terms. In short: unopened/unused items can typically be returned within 30 days; shipping charges are non-refundable unless we made an error; defects must be reported within 7 days with photos.

7) Promotions & coupons

Promotions cannot be combined unless stated. We may modify or end promotions at any time.

8) Intellectual property

All content on the Site (text, images, logos) is owned by NYC Guardians or its licensors and is protected by law. You may not use our content without written permission.

9) Acceptable use

Do not misuse the Site (e.g., attempt to break security, scrape content, or interfere with operations).

10) Warranties & disclaimers

Products are provided “AS IS.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Information on compostability and disposal is provided as general guidance only and may vary by location.

11) Limitation of liability

To the fullest extent permitted by law, NYC Guardians will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any amount exceeding the price you paid for the applicable product(s).

12) Indemnification

You agree to indemnify and hold NYC Guardians harmless from claims arising out of your misuse of the Site or breach of these Terms.

13) Governing law & venue

These Terms are governed by the laws of the State of New York, without regard to conflicts of law. You agree to the exclusive jurisdiction and venue of the state and federal courts located in New York County, New York.
